WEBSITE AND MESSAGING TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of the Touchstone Closing website and your participation in electronic communications provided by Touchstone Closing & Escrow, LLC (“Touchstone,” “we,” “us,” or “our”), including our SMS, MMS, and RCS messaging program.
By using our website or opting in to our messaging program, you agree to these Terms.
Touchstone Closing Messaging Program
The Touchstone Closing Messaging Program provides transactional communications relating to real estate closing, title, escrow, settlement, and related services.
Messages may include:
• Closing scheduling invitations
• Appointment confirmations
• Closing reminders
• Scheduling changes
• Closing location information
• Transaction status notifications
• Requests for transaction-related information
• Other service-related communications concerning your transaction
The program is intended primarily for transactional and customer-service communications.
Consent to Receive Messages
By providing your mobile telephone number and affirmatively opting in to receive messages from Touchstone, you consent to receive SMS, MMS, RCS, or similar electronic messages relating to your transaction and Touchstone’s services at the number provided.
Consent to receive text messages is not a condition of purchasing goods or services.
You are responsible for providing a valid mobile number and notifying Touchstone if your number changes.
Message Frequency
Message frequency varies depending upon your transaction, scheduled closing, and interactions with Touchstone. You may receive multiple messages during the course of a real estate transaction, particularly as a scheduled closing approaches or if scheduling information changes.
Message and Data Rates
Message and data rates may apply.
Your wireless carrier’s standard messaging and data charges may apply to messages sent or received through the program.
Opting Out
Reply STOP to any Touchstone text message to unsubscribe from SMS/RCS messaging.
After you send STOP, you may receive one final message confirming that you have been unsubscribed. After your opt-out has been processed, you will no longer receive messages through that messaging program unless you subsequently provide consent to receive messages again.
Opting out of text messaging does not prevent Touchstone from communicating with you through other appropriate channels when necessary in connection with your transaction.

Delivery
Wireless carriers and communications networks control message delivery.
Carriers are not liable for delayed or undelivered messages.
Touchstone does not guarantee that any SMS, MMS, or RCS message will be received within a particular period of time.
RCS and SMS Fallback
Where supported, Touchstone may communicate using Rich Communication Services (“RCS”), which may provide branded messages, interactive buttons, suggested responses, images, or other enhanced functionality.
If RCS is unavailable or unsupported by a recipient’s device or wireless carrier, a communication may be delivered using SMS or MMS instead.
Appointment Confirmations
Electronic appointment confirmations are provided for convenience.
If you believe an appointment confirmation contains incorrect information or you need to change your appointment, contact Touchstone promptly.
Interactive responses such as “Confirm Appointment” may be used to record your confirmation electronically.
No Sensitive Financial Information by Text
Do not send Social Security numbers, bank account numbers, passwords, wiring instructions, or other highly sensitive financial information through SMS, MMS, or RCS unless Touchstone specifically directs you to an approved secure method.
Touchstone will not use a text message alone to instruct you to send funds to a new or changed bank account.
Always independently verify wiring instructions using a trusted telephone number before sending funds.
Privacy
Your participation in the Touchstone Closing Messaging Program is subject to our Privacy Policy and GLBA Privacy Notice available at:
Touchstone does not sell or share mobile numbers or SMS/RCS opt-in information or consent with third parties or affiliates for their own marketing or promotional purposes.
Availability and Changes
Touchstone may modify, suspend, or discontinue website features or messaging functionality at any time.
We may update these Terms periodically. Updated Terms become effective when posted unless otherwise stated.
Website Information
Information provided through the Touchstone website is provided for general informational purposes. Website content should not be relied upon as a substitute for transaction-specific instructions or professional advice applicable to your circumstances.
Intellectual Property
The Touchstone name, logos, website content, graphics, and other materials are owned by or licensed to Touchstone and may not be copied, reproduced, distributed, or used without authorization except as permitted by law.
Governing Law
These Terms are governed by applicable federal law and the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.
